What is Probate?
Probate is a court-supervised process that determines the value of a deceased person’s property and how it should be distributed to their heirs. It’s designed to prevent fraud, and it effectively freezes the estate until a judge determines that the will, if there is one, is valid, that everyone involved has been notified of the death, and that all of the deceased’s property has been identified and appraised.
Probate proceedings happen in the circuit court of the county where the deceased property owner lived or maintained their usual place of dwelling.
